Dealing with property certainly takes time and effort as they require a considerable amount of investment. Also, property documents are sensitive in nature as well. Hence, before you decide to purchase any property, you should understand the ins and outs of the transaction process to ensure a smooth property handover. First of all, the core document stating the property handover is Khatiyan, and one must mutate his or her name to claim ownership in Khatiyan. Moreover, there are several Documents required in property mutation process and you must follow the entire process for a proper mutation. What is Mutation?

Mutation is a property documentation procedure through which the previous owner of the property replaces his or her name with the new owner in the Khatiyan (Records of Rights)

Why is Mutation Important?

Without mutation, one cannot officially claim ownership of the property. Moreover, if owners do not mutate a property with the name of the new owner, the property can still be legal under the ownership of the previous owner. Also, you need to mutate your property for registration, taxes and other property related matters.

How Property Mutation occurs

Common Documents for land mutation process:

  • Copy of the main deed,
  • Via deed
  • Copy of Khatiyan
  • Receipt of payment of land development tax,
  • Proof of means to acquire the ownership i.e partition deed,
  • Copy of the decree or judgment obtained from a competent court (if any),
  • Passport size photograph of the applicant
  • Additional required documents

Time needed for Mutation:

Usually, it takes 60 days to finish the whole process of mutation in the metropolitan area. And for other regions, it is usually 45 days.

Above all, even before you decide to purchase any property, check the legal documents first. Once you get all the documents and verify with local land offices, only then you should proceed for the land mutation process. Finally, you will receive the proper documentation of your ownership of your property.

    I have a property that was jointly owned by 3 brothers that are divided among us under hepa law and registered in November 2019. I still can not obtain Namjari on my registered land. Is there a government directive as to who is responsible to complete the task and how long a consumer like myself need to await to receive rightful service from the gornment. Is there any check and vallence as to how offices of AC land, Subrerister office etc. performs their service to public. Whatever I faced I believe is no different than any other consumer. One year is aweful long time to get a namjari done in todays advance technological ara. In the USA everything done online and very effectively. A process is good only when it is implemented. There is no lack of process and directive in bangladesh, but very few can carry out these government directives.
