Because if not executed, there is a possibility to become ousted from the property due to loopholes in the law. Yet, to many people, the process of mutating a property is hard to understand.

What is mutation

Mutation Khatiyan or Namjari is a legally upheld document that is prepared to rule out any complication regarding the ownership of a piece of land. 

When a person or organization gets the ownership of a piece of land legally by updating the ownership information in the government’s record, it is called Mutation Khatiyan or Namjari. In other words, a Mutation khatiyan is creating a new khatiyan by replacing the name in the existing khatiyan.

After executing the Namjari, it is given to the new owner. It records the name of the new owner, which mouza, mouza number (JL number), survey number, total land in the land, the amount of land allotted to more than one owner and the rent levied (land development tax) every year.

Failure to mutate the property in the name of the new owner after transferring the ownership of the property can lead to complications in acquiring the property, paying land tax, selling the property, and getting a bank loan. 

You can also become a victim of harassment and fraud. For example, when you do not execute the Mutation Khatiyan, the name of the previous owner remains in the record and your name is not recorded in the record of rights as the buyer. On the one hand, you cannot sell or donate property, just as you cannot be a taxpayer. 

Moreover, since the record remains in the name of the previous owner, the former owner can claim the property by resorting to unfair means. So Mutation Khatiyanis very important for the legal protection of newly purchased property.

Also, Namjari is a mandatory document in pursuing a bank loan. Without it, applying for a mortgage loan or building a house is not legally possible.

You have to collect the specific application form from the Assistant Commissioner (Land) office and fulfill it the proper way. A detailed description of the property or land you want to register should also be given here. Or you can just apply online for Mutation-Khatiyan or Namjari.

Requirements in the application form:

  1.  Full name and address of the applicant
  2. The number and year of registered transfer documents such as sub-kabla, heba, will etc. should be clear.
  3. Copy of Deed, Photocopy of Bia Document (if any)
  4. Copy of Parcha or Khatian
  5. Receipt for payment of DCR and land development tax
  6. Distribution Deed (where applicable)
  7. If you want to register any Warisan land, you have to submit a Warisan certificate (issued within three months).
  8. Photocopy of the previous owner’s Mutation Khatiyan(if applicable)
  9. A copy of the decree if it is executed by a court order
  10. 2 passport size photographs of the applicant or the applicant’s representative
