A property’s ownership can be exchanged in numerous ways and for that you are legally required to register the property through one of the exchanged deeds that are currently practiced in Bangladesh. For instance, if someone wants to purchase a property, they have to prepare a saf-kabla deed. But if you are a Muslim, you have the option to donate your property in exchange for any items that have religious value such as praying rugs, praying beads, or the holy Quran. This exchange process is called Hiba-bil-iwaz in Islamic sharia. However, like any other deed, there are certain fees associated with a Hiba-bil-iwaz deed. In this article, we will discuss everything from the registration fee of Hiba-bil-iwaz deed and other important things.

Heba deed

A Hiba-bil-iwaz deed is a type of deed that is in accordance with the Islamic laws where property ownership is gifted or donated in exchange for items that have religious values such as the Holy Qur’an, prayer rugs, praying beads, gold ornaments, Maharana money, etc. This will allow the recipient to have ultimate power over the property including property transfer rights. 

According to Islamic law, any sound of mind and non-minor Muslim can transfer their property through the Hiba-bil-iwaz deed at will. Properties that are transferred through Hiba-bil-iwaz don’t require any pre-emption right.

There are different types of deeds and every deed including the Hiba-bil-iwaz deed includes five fundamental information-

  1. Detailed information about the property
  2. Proper information or identity of the seller or giver
  3. Proper information or identity of the buyer or receiver
  4. Proper information or identity of the witness
  5. A date denoting the completion of the deed

Like we mentioned before, every type of deed has some fees associated with it. The Hiba-bil-iwaz deed is no exception. During the registration process of a Hiba-bil-iwaz deed, you have to pay stamp duty and local government tax in addition to the registration fee. Here is how much you have to pay during the registration-

Registration fee: 1% of the total deed value of the property
Stamp duty: 1.5% of the total deed value of the property
Local Government Tax: 3% of the total deed value of the property (if the property is not under the jurisdiction of city corporation or cantonment board); 2% if it is under the jurisdiction of city corporation or cantonment board.

The other important things

In addition to the fees, taxes, and duties mentioned above, the following charges and fees are mandatory for each document:

  1. Affidavit on a stamp will cost BDT 200
  2. E-fee: BDT 100 will be applicable
  3. N-fee
  • In Bengal, for every 300 words, one page or part of it will cost BDT 16
  • In English, for every 300 words, one page or part of it will cost BDT 24
  1. (Remuneration of counterfeiters) NN Fees: –
  • For every 300 words in Bengali, one page or part of it will cost BDT 24
  • For every 300 words in English, one page or part of it will cost BDT 36
  1. A court fee of BDT 10 per application for transfer of property will be applicable
